GENERAL SALE CONDITIONS

The purchase of products from the Fashionis.com website is regulated by the following general conditions (henceforth denominated “General Sale Conditions”), which you are asked to read before concluding your order.

VENDOR
“Fashionis” and “Fashionis.com” are registered trademarks owned by the company Fashionis S.r.l., whose legal address is in Scandicci (FI), Via Vittorio Michelassi 4/6, Italy (henceforth denominated “FASHIONIS”).
FASHIONIS is the vendor of products on sale from the Fashionis.com website.
These general sale conditions apply only to purchase orders carried out via the Fashionis.com website according to the conditions and terms specified in point 4 of this document. Furthermore, the General Sale Conditions do not regulate the purchase of products or the providing of services by other subjects beside FASHIONIS, which may be visible on the Fashionis.com website via links or banners.

ADDRESSEES OF THE COMMERCIAL OFFER
FASHIONIS offers the sale of its products via the Fashionis.com website exclusively to “consumer” users.
“Consumer” means the physical person acting according to purposes alien to eventual entrepreneurial, commercial or professional activities.
FASHIONIS maintains the right to not fulfil purchase orders from subjects who do not belong in the aforementioned “consumer” category and, more generally, purchase orders which do not conform to these General Sale Conditions.

GUARANTEES AND PRODUCT PRICES
On the Fashionis.com website, FASHIONIS offers the sale of exclusively original, authentic and first rate quality products, acquired from the most prestigious and established fashion brands on the market. FASHIONIS does not sell second-hand products, yet if certain specific products should present particular characteristics (for example due to the type of materials or due to peculiar manufacture techniques), FASHIONIS will distinctly indicate such characteristics within the product profile.
All articles on sale from the Fashionis.com website have been acquired directly from production houses or authorized distributors. Thus, in the event of damage caused by the products, FASHIONIS declines all responsibilities, which are to be assigned to the relative producer.
Furthermore, FASHIONIS will not responsible if the photographs of products on sale from the Fashionis.com website should not accurately correspond to the real product due to your monitor or browser settings or to further malfunctions that are independent from the activities of FASHIONIS.
The products on sale from the Fashionis.com website are all provided with their own label and seal, which are considered an integral part of each product. FASHIONIS maintains the right to not accept the returning of products without their relative label and seal.
The prices of products on sale from Fashionis.com may undergo updating procedures and may differ according to the Country where the relative product is to be sent. Thus we ask you to carefully check the final price before concluding your purchase order.

HOW TO CONCLUDE A PURCHASE ORDER
In order to fulfil an online purchase order from the Fashionis.com website, you must have a valid e-mail address and meet the necessary legal requirements to stipulate the relative purchase contract with FASHIONIS.
The language you may use to complete your purchase order from Fashionis.com is English.
You can complete a purchase order by following this procedure:

1. DAfter having chosen to buy one or more products, insert them in the cart and click on “Add to cart”.
2. Compile the order form by following the instructions. The order form distinctly indicates the essential characteristics of the ordered goods, the relative price (including all taxes and levies), mailing expenses, modalities for payment and mailing of the goods, and includes an express link to the "Returns and Refunds" section, where you will find indications regarding the terms, time and conditions to exercise your right of withdrawal and to return purchased goods.
3. Before transmitting the order form, you will be asked to read the General Sale Conditions and the Informative Report regarding the right of withdrawal and to print and keep a copy for personal use. We ask you to read carefully the contents of these sections, as well as those of the "Privacy" and "“Conditions for Use and Copyright" sections, indicated by specific links, as once you transmit the purchase order you will be considered to have read and accepted these notions in full.
4. Before transmitting the purchase order, you will also have the possibility to verify the inserted data in order to correct eventual mistakes.
5. To transmit the purchase order to FASHIONIS click on “Send order”. At the moment when FASHIONIS receives the order form you have sent, the sale contract will be considered to be fulfilled.
6. Following the reception of your order form, FASHIONIS will send you an e-mail including a receipt for the order, which will contain the same information as the order form (essential characteristics of the ordered goods, price, mailing expenses, modalities for payment and mailing of the goods, and an express link to the “Returns and Refunds” section) and will provide to process your purchase order.
7. Your order will be archived in our database and you will be allowed to consult it in any moment by logging into your Account.

FASHIONIS maintains the right to not process purchase orders featuring missing or incorrect data, as well as orders which do not guarantee solvency. In these cases, you will be informed via e-mail of the failed processing of the order and of the relative reasons.
Furthermore, FASHIONIS maintains the right to not process purchase orders if the ordered goods are, for any reason and even if only temporarily, unavailable. In this case, within 30 days from receiving your order, FASHIONIS will inform you via e-mail that the products are unavailable and will proceed to refund any payments you have made.
FASHIONIS maintains the right to only accept purchase orders regarding products to be sent to Countries listed in the Mailing page of the Fashionis.com website. In particular, purchase orders regarding Italy, France and the United Kingdom must be made by using the Fashionis website relative to each specific Country. Purchase orders regarding products to be sent in UE countries other than Italy, France and the United Kingdom can be made by using any Fashionis.com website. You can choose the correct website by selecting the name of the relative Country from the specific panel in the top right corner of any page of the Fashionis.com website.

PAYMENTS
The order form distinctly indicates the various payment modalities regarding products and their relative mailing expenses.
Once the purchased products have been dispatched, you will be charged the price indicated in the order form for the purchase of the products and for their relative shipping expenses.
If you intend to pay via credit card, FASHIONIS will transmit the relative banking information (for example, the credit card number and the name of the holder) to Barclays or to the eventual other bank that will process the online payment service. FASHIONIS guarantees that no other party will have access to such data and that this information will be used exclusively to process the purchase procedure, to credit the relative refund if you should choose to return the products according to your right of withdrawal, or if it becomes necessary to report eventual frauds committed on the Fashionis.com website to competent authorities.

DISCOUNT CODES
FASHIONIS may decide to offer you specific discounts codes
Two types of discount codes exist:
- a discount consisting of a specific sum, which you may use if your order exceeds the value of the discount by at least 1 euro;
- a percentage discount on a specified number of products. This percentage discount may be applied, depending on the case, to a minimum of 1 up to a maximum of 5 products amongst those inserted in your shopping cart. If you have added a number of products to your cart that is superior to the maximum number of products which may be discounted, FASHIONIS will automatically apply the discount to the product (or products) with the highest price.
You can use the discounts regarding the prices of products on sale from the Fashionis.com website by using the relative codes as communicated by FASHIONIS.
Once you have obtained the code, to use the discount access the shopping cart containing the goods you intend to order, insert the code in the specific box and click on “Apply”.

The use of discounts is subject to the following limitations:
- it is not possible to accumulate more than one discount offer within the same purchase order;
- the discount on more than one article may only be used if such articles are purchased contextually within a single purchase order;
- the discount can in no case be converted into cash;
- the discount may only be used once, except for what is established regarding the eventuality of the returning of the product.
If you intend to return goods you purchased by using a discount, you simply need to follow the normal return procedure as indicated in the "Returns and Refunds" section. Should your return be accepted by FASHIONIS, you will receive the refund of the price you paid to purchase the goods and you will no longer be allowed to use the relative discount.

SHIPPING AND DELIVERY
Accepted orders will be dispatched and delivered through a courier service chosen by FASHIONIS. To acknowledge all details regarding the modalities of mailing and delivery of the goods, please consult the "Shipping" section.
We invite you to read the content of the “Shipping” section carefully, as it is considered an integrant and substantial part of these General Sale Conditions and you will thus be considered to have acknowledged and accepted such contents when you decide to send the order form.

RIGHT OF WITHDRAWAL
You have the right to withdraw from the purchase contract with FASHIONIS, with no penalties or need to specify the reason, within 10 workdays from the date on which you received the goods purchased from the Fashionis.com website. If your return is accepted by FASHIONIS, you will receive a refund corresponding to the relative price of the purchased goods.
We ask you to consult the “Returns and Refunds” section in order to acknowledge all details regarding the modalities, terms and conditions of your right of withdrawal.
Furthermore, we remind you that the contents of the “Returns and Refunds” section are an integrant and substantial part of these General Sale Conditions and you will thus be considered to have acknowledged and accepted such contents when you decide to send the order form. Therefore we ask you to read all indications this section contains carefully.

FASHIONIS aims to protect your privacy as much as possible.

CHANGES TO THE GENERAL SALE CONDITIONS
FASHIONIS maintains the right to modify or update these General Sale Conditions should changes be deemed necessary or appropriate. Thus we ask you to periodically consult the General Sale Conditions section and, in any case, to read this section carefully before placing each order.

APPLICABLE LAW AND ARBITRATION
The General Sale Conditions are regulated by Italian law, and in particular by the Legislative Decree n.206 6 September 2005 and by the Legislative Decree n.70 9 April 2003 regarding electronic commerce, as well as all other applicable laws in force regarding the subject.
Should any disputes arise against FASHIONIS due to the General Sale Conditions, FASHIONIS will adhere to the RisolviOnline arbitration service.
